What is the most effective way to market to large insurance companies in CA providing worker’s compensation investigative service? Are there leads I can obtain to market my business and what type of marketing source could I use these days?

Should I send brochures, send emails, contact them directly; any suggestion would be appreciated greatly. Thank you.

It depends what it is you are trying to sell – products and services, for example, need marketing in very different ways. For example, if you are in the service sector then advertising may not the most effective tool for filling the pipeline.

settle this case fast. cause my lawyer is about to file a lawsuit it’s been 2yrs sent the patient died.so can you or somebody tell me if you have a slam dunk, open and close, wrongful death case don’t you think the defendant will settle.oh did i mention there are two defendants in this lawsuit there’s a hospital and a nursing home both parties killed the patient. sepsis syndrome, bacteremia was the leading cause of his death. answer this question please

There is no such thing as a slam dunk involving a hospital death. Just because YOU think it’s obvious does not mean the judge or jury have to agree.

If I put a gun to your head and pull the trigger, with several reliable eye witnesses, THAT’s a slam dunk wrongful death. Someone dying in hospital of sepsis is far from that. The cause of death alone does not establish culpability.

So no, the odds of this settling quickly are small, unless your claim is less than the cost of the trial.

In recent speeches, Democrat Presidential candidate Barack Hussein Obama has attempted to use the fact that STATES require drivers to purchase LIABILITY INSURANCE as a precondition for driving as some form of president for his claim to force the American people to pay into a FEDERAL SOCILIZED HEALTH CARE SYSTEM.

Putting aside the fact that the government is not know for its efficiency or domestic problem solving ability (Liberals, you do remember that your “War on Poverty”, run by the government, lead to skyrocketing taxes which subsequently drove small businesses out of business and caused poverty to worsen, right???), doesn’t Hussein Obama realize that there is a difference between LIABILITY INSURANCE and Socialized Hillarycare???

The liability insurance that most states require drivers to obtain does not protect the driver themselves, but anyone that driver might accidentally injure in an auto accident.
Thus, while drivers are required to obtain this liability insurance to cover any damages they might inflict, they are free to take out as much, or as little insurance on their own vehicle as they choose.

Socialized Health Insurance, such as what Hussein Obama is proposing would FORCE American citizens to pay the government to provide them with far less insurance then they could obtain from private insurers for the same amount of money.

Since no state currently FORCES drivers take out insurance on their own vehicles, wouldn’t the precedent set by the state auto insurance laws be that the government CAN’T FORCE us to buy into any Inefficient Socialized Government-Run Health Insurance Plan???

BY THE WAY; I thought that these same Democrats who are currently seeking to deny me he right to choose my own health insurance, claim to be “Pro-Choice”. Does the Liberal claim of being “Pro-Choice” only extend to the murder of children???

Lets also note many Americans (especially New Yorkers) can choose NOT to own a vehicle………and therefore are not subject to pay for insurance they don’t need or want. Why would we accept a FORCED PROGRAM? Many Americans don’t want insurance because they believe they are healthy and can pay as they go. It is their money / assets they are gambling with should a catastrophic medical event take place. I believe adults are capable of weighing the risks of being unisured. (And those who can’t afford insurance get MEDICAID!) No one in this country is denied HEALTH CARE REGARDLESS OF INCOME OR ABILITY TO PAY!!!

Will my idea(s) work? I want to start a small local retail business.?

1st, I want to create 1 small (privately held) 24 hr. retail store, and do it my way, (A retail business model of excellence, a store where local customers all have their own I.D. and savings card). The store would plan for 15-20,000 sq. ft. or about 10% of the U.S. leading large retail store (not counting loading dock or warehouse for stock). Store will have 3-5% more employees than needed per shift for customer service. Store property will have 150-175 security patroled spaces for parking with night lights 10-15% more brighter than what is required. Employee and delivery entry and exist(s) are separate from customers. Store will carry a wide range of consumer goods and services; the top 70-80% of what one might consider to be found in a contempoary consumer retail store…with express check outs, at each register. 2nd, there will be separat "employee" and "customer" profit sharing. Free on site day care and medical insurance for employees. What do you think? Do I have a chance?

Well it sounds like you have given this a lot of thought, and have designed a really cool place to work and shop. Way to go!

But lots of really cool buisnesses go out of buisness every day. What will determine if you sink or swim or not will be the local market.

A) Is there a need for such a store in the area? Most small business sink because the owner opens the sort of store THEY want to run, not the sort of store anyone needs to go to. For example, even if you have wanted to run a bookstore since you were 5, opening up a bookstore around the corner from a giant BORDERS and down the street from the public library, well that’s just not the best idea. If however you notice that there isn’t a hardware store for 30 miles in either direction, and you open up a hardware store instead of a bookstore you will be serving a market that hasn’t been served yet, and have a better shot as making it.

B) Is there a NEED for such a store in your community? EXACTLY what sort of "wide range of consumer goods and services" will you be selling? Why are you going to be 24 hours? How many people really need to buy lawnmowers at 2AM? Is there a need in your community for people to buy potted plants at 7AM on a Sunday Morning? Do you expect a lot of people to be buying toys and watches at 11PM on a Wednesday? You need to answer these questions and think about them before you go forward. That is what a good buisness plan is for.

C) What is your competition going to be? Sounds like you are looking to be in direct competition with Walmart and Target. That’s some pretty tough competition. Walmart has some serious cost advantages due to their distibution system being hyper efficent. They strong arm their suppliers for low prices and volume discounts and are non-union to boot. It is virtually impossible to undercut them on price. Lots of people have tried, and lived to regret it. (Economists estimate that if it wern’t for Walmart inflation in the US would be about a full point higher than it is today.)

I applaud your desire for free on-site daycare and medical insurance. It would be great if more employers were like you. However there is a reason more employers aren’t like you, it costs a LOT of money. Starbucks has full health insurance for all employees, but they are selling a cup of coffee for $2.50, so their margins are fantastic and they can afford it. You on the other hand have to make that cost up somehow, and if your staff is larger than Walmarts and they all have health insurance it is going to be REAL tough to stay in the same price range as Walmart. If your prices are higher than Walmart’s, well people will go to Walmart instead.

To make this work you will have to come up with a reason for people to pick your store and NOT Target or Walmart or your other competition. What can you do for me, the customer, that they can’t? It’s nice that your parking lot lights are brighter than the law requires and you don’t treat your employees like dirt; but folks won’t notice that… they will notice if your lawnmowers and frozen pizzas cost more than the ones at Walmart and Target though. Oh sure, people love to complain about the long lines and the lack of service and rotten decor at Walmart, but push come to shove, saving a $1.98 on flashlight batteries and getting a sweater for 20% less than it would cost at the mall always beats service and decor. People will stand in line if it means they get lower prices and can get more for their money.

You sound smart and like you are willing to work hard. That’s half the battle, but it’s only half. Figure out what YOU can do that your competition can’t. That’s your key and that’s your angle. Then you will have a good shot at it.

Should Insurance cover water heater damaged due to failed pressure reulator?

The pressure regulator on my home’s incoming water line failed, leading to community’s incoming 160PSI pressure (rather than the regulators 60-70) bursting my hot water heater.
My insurance company says they will pay water damage (minus deductible) due to flood, but will not reimburse for the water heater.
If they are willing to compensate me for house damage due to failure of the water heater, why won’t they reimburse me for damage to the water heater due to failure of the regulator?
Clarification. The question is, if the company agrees it is liable for damage due to failure of equipment, the failing equipment was infact the regulator, and not the heater; and therefore the heater should be covered.
Example: If a tornado knocked down my walls and destroyed my water heater it would be replaced, because the tornado is an external force acting on the water heater; So is the water pressure from outside the house. If they do not want to replace the regulator because of wear and tear that’s fine. However, the water heater did not fail in the course of normal operation. It was damaged.
Update: So far your answers seem incorrect. State Farm is tentatively agreeing with me that, if the failure in the regulator caused pressure to burst the regulator, the water heater and flood are both precipitant effects and are covered.

Well, let’s go to the standard homeowners policy and see what it says: (Section 1, perils insured against) We do not insure, however, for loss (2) caused by (e) any of the following (2) inherent vice, latent defect, mechanical breakdown. If (any of these) cause water damage not otherwise excluded, from a plumbing, heating, air conditioning, or household appliance, we cover loss caused by the water including the cost of tearing out and replacing any part of a building necessary to repair teh system or appliance. WE DO NOT COVER LOSS TO THE SYSTEM OR APPLIANCE FROM WHICH THIS WATER ESCAPED.

There ya have it, word for word, from an HO3 policy form. The damage the water does is covered. The damage to the system itself, is not. Why? That’s the way the contract is written.

Why is the heater covered if it burns? Because fire damage is not excluded under the policy. Mechanical breakdown – from whatever the cause – IS excluded from the policy.

United Socialist States of America?

We have a socialist retirement system. We have a socialist health care system for the elderly. We have automobile and aviation companies on the verge of bankruptcy or government ownership due to legislation and regulation in oil prices that could be half of what they are if Congress got out of the way. Look at me. The problem with General Motors and Ford and Chrysler and domestic auto manufacturers is not that they don’t know how to run their business. They are all kicking butt internationally. Ford, General Motors are selling cars out the wazoo internationally. You know what they don’t face? The same kind of onerous regulation they have here. You want to fix the Ford auto industry, General Motors, local, domestic auto industry, just get rid of the CAFE standards. The idea that people that run the auto companies do not know how to make cars that people want has been obscured by the fact that they’ve been forced to make cars fitting mandates offered by government, people in government who have never built a car, have never designed a car, have never marketed nor sold a car. Just get government out of their way, and then let ‘em sink or swim on their own. How is it that all three of them are up the creek? All three of them face the same onerous regulations.

What about oil prices and the effect on the price of a car and the mileage and the kind of car you want? Get Washington out of the way on that, not this phony bill that Nancy Pelosi ushered through the House. We can drill everywhere there isn’t oil now, and you know why they had to usher this through? ‘Cause they knew it was a losing issue for them. We had ‘em right between the eyes. We had ‘em right in the palm of our hands. They were on the wrong side of this drill, drill, drill, right here, right now, business, so they usher through this stupid thing. It’s the same, the Gang of Ten, gang of 16, now gang of 20 in the Senate — oh, yeah, we’re going to allow drilling, we’re going to drill, drill, drill, but it’s gotta be further than 50 miles offshore. Most of the oil is closer than that, so Big Oil has been told go ahead and invest and drill where there isn’t any oil, which they won’t do.
